Alan Weiss’s Monday Morning Memo® – 6/19/2023

We’re back in Pt. Pleasant, NJ on our annual summer pilgrimage in what’s known in the family as “the red roof house.” My favorite time here is about 8 in the morning, when I’m on the beach almost alone, the lifeguards not on duty until their 9:30 (my 10:00). It’s me and the gulls and the surf.

But not this year. This year, the beach is locked, the police will remove you if you manage to get onto it, and they unlock the gates at 9:30. I don’t know why, but I assume they’re afraid of liability, of someone swimming at their own risk, of fear itself.

There are additional signs along the boardwalk—the kind that light up on mobile carts—sternly warning that people cannot “gather there.” (In other words, no crowds or hanging out.)

I’m all for public safety and against public drunkenness (although Las Vegas seems to encourage the latter), and I’m happy with police presence. But at what point is the government’s fear starting to intrude on the public’s freedom? I’ve always questioned TSA’s approach—that we’re all guilty until proved innocent, and that they’re unable to accept a retinal scan and/or fingerprints to speed all of us good people along.

I know what you’re thinking: So wait another 90 minutes to go on the beach, it won’t kill you. And you’re right, except to what extent is fear eroding freedoms? Disrespect for one law often creates disrespect for all laws, yet we all exceed the speed limits almost all of the time. Does erosion of some freedoms create a philosophy of accepting erosions of larger freedoms? Social media can ban us, and elements of the current culture try to “cancel” us.

Or are we actually more afraid of lawsuits than we are of terrorism?

If you’re going to insist on monitoring adults in recreation activities, how about getting your beach badge people and lifeguards on the job earlier? I’ve been going to the beach here and elsewhere early for 50 years. No one has ever drowned, though there is a danger, I acknowledge, just as I acknowledge there’s a danger in driving in excess of the speed limit.
